Abstract: This article concerns the degree to which a trustee based in England and Wales could be found personally liable for the remediation costs attributable to contaminated land. Exploring the nature of this liability is what this article seeks to achieve. It is shown that while this is an unlikely environmental risk in practice, it can nevertheless have significant implications for trustees should it arise.
