Modern piracy is very much a live issue for the shipping industry. Most standard contracts used in practice do not provide adequate answers to the questions posed, leaving us with an alarming number of legal uncertainties. Reflecting the emergence of a new model of piracy, new special-tailored piracy clauses, standard armed guards employment contracts and marine Kidnap & Ransom policies have been drafted. The research examines how risk distribution between different parties needs to be reconsidered and how the problems emerging can be avoided by contractual mechanisms.
