Abstract: In this first article of two, the author considers some of the legal issues surrounding the matter of consent in healthcare when a patient has not yet reached the age of maturity. This article specifically considers children of tender years as to who can agree to treatment of a child of tender years and also looks at when there may be disagreement between those with parental responsibility as regards treatment and also when there may be disagreement between those with parental responsibility and the medical profession.
