The adoption of the ASEAN Human Rights Declaration on 18 November 2012 represents an important stage in the development of the human rights system of the Association of Southeast Asian Nations (ASEAN). It follows commitment to the establishment of a regional human rights body in the ASEAN Charter of 2007 and the establishment of the ASEAN Inter-governmental Commission on Human Rights (AICHR) in 2009. This article argues that the ASEAN Human Rights Declaration consists of three constitutive elements: politics (or a political context), process and product. It examines each in turn, arguing that the product is less important than the process and political context that shaped it. It concludes by mapping out possible future directions in the development of the ASEAN human rights system. |
